1. Acceptance of Terms

By accessing and using the services provided by BlogHunch Software Pvt Ltd ("Entesta", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services Description

Entesta provides SaaS development services including but not limited to MVP development, full-stack development, mobile app development, UI/UX design, and related consulting services. Our services are delivered through various subscription packages and custom engagements.

3. User Accounts and Registration

To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payment Terms

Payment terms vary by service package. Subscription fees are billed in advance on a monthly or annual basis. Custom project fees are outlined in separate statements of work. All fees are non-refundable except as expressly stated in your service agreement.

5. Intellectual Property Rights

All intellectual property rights in the services and any custom software developed for you remain with Entesta unless explicitly transferred through a separate agreement. You retain ownership of your data and content provided to us for service delivery.

6. Confidentiality

We understand that you may share confidential information with us during the course of our engagement. We commit to maintaining the confidentiality of such information and will not disclose it to third parties without your consent, except as required by law.

7. Service Level Agreements

Service level commitments are outlined in your specific service agreement. We strive to maintain high availability and performance standards. Service credits may be available for failure to meet committed service levels as outlined in your agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Entesta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

Either party may terminate services with appropriate notice as outlined in your service agreement. Upon termination, you will receive any deliverables completed up to the termination date, and we will assist with knowledge transfer as reasonable.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our website. Continued use of our services after such modifications constitutes acceptance of the updated terms.
